Creating A Fruitful Kingdom Account

You must own the copyright to any image(s) you use on our website or services. You grant Fruitful Kingdom a commercial license to any image(s) you submit by default, such as a Facebook profile picture or other profile picture you voluntarily provide when accessing the offering or upon our request. We are not obligated to notify you of our use of any image(s) you submitted voluntarily or by default. Your content may be used for our business in the future.
Our Rights To Terminate Your Account
It is our right, at any time, to suspend or terminate your license of use for our website, services, and your account, with or without cause or notice to you, if any information provided during the registration process or after is proven misleading, inaccurate, or false, or to reclaim any username that you create through our services that violates our Terms & Conditions. Your responsibility is to maintain the confidentiality of your account information and password. Your Accuracy of Billing, Accounting & Financial Information
Your Responsibility – Accuracy of Data
You acknowledge and agree to use current, complete, and accurate information for accounts and purchases from our Store. You must promptly update your information, for instance, email, physical address, and credit card details, for transaction and communication purposes.
Our Displayed Prices
The prices payable for items are found in our Store. All prices are displayed as U.S. dollars ($USD) unless specified otherwise and include V.A.T. (G.S.T.), where applicable. Suppose we mistakenly underprice an item and notify you of this mistake before we dispatch or make the item available for dispatch. In that case, we are not obligated to supply that item at the stated price.
Your Payment Method
Your order is a purchase offer from Fruitful Kingdom. A contract exists between you and us once and when we receive payment. When you place an order for which payment is required, you must give authority for payment. Payments are made electronically through our website.
When you pay by debit or credit card, you authorize us to verify your details from your card issuer for security reasons or to confirm that you have sufficient funds. This may involve verifying your data, such as your name, address, or other information, with your bank or credit reference agencies as necessary.
Payment may be taken from you between your order placement and us providing the services or you requesting access to content. We will email you confirmation of the contract and acceptance of your order.
We might decline to provide you with our services or digital content at any point until then without reason. If a payment is taken from you and we fail to deliver our services or make the digital content available to you for any reason, you will be refunded fully.
Your Recurring Payments
Suppose you sign up for a payment plan. In that case, you authorize us to continue accessing your financial data stored through our third-party financial processing provider, referenced in this agreement, until your payment plan is complete. Please refer to our purchase terms upon checkout.
If you object to any change, you can cancel using our website and the ongoing provision of products or services within 30 days of the change by contacting us at jesse@fruitfulkingdom.com. We will refund any advance-paid sums related to canceled products. Nevertheless, you are not entitled to a refund if you have downloaded or accessed our products.
Your Chargebacks
You agree to make reasonable attempts to obtain a refund before making a chargeback attempt through your financial institution. Suppose you attempt a chargeback; in that case, you expressly agree to forfeit any of our bonuses, one of our affiliates, or other offerings to you in exchange for your original purchase. We maintain the right to present proof of your access to these Terms & Conditions to the financial institution investigating the dispute.
Our Rights to Refuse a Refund
We may refuse your request for a refund if:
Your past purchase history with us indicates that you have previously placed an order after having requested a refund;
Your payment is associated with chargebacks or dispute attempts;
You have accessed other purchased premium content after requesting a refund;
We have probable cause to believe you have shared access to your Premium Profile, their download link(s), or access credentials with someone other than yourself (e.g., if there have been access attempts from any different locations);
Your provided information is intentionally misleading.
Under the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, your statutory cancellation rights remain unaffected. Our Returns Policy provides more information on your rights.
Your Purchase of Products & Services
We offer products (physical and digital) and subscription services for purchase on our website. They are provided as described, and we reserve the right to change the descriptions of products and services offered.
We retain intellectual ownership over all our products and services, which remain our property. The products’ intellectual property rights (including copyright) stay with us and our authors/licensors, as applicable.
Our e-books are in PDF format. You may require an up-to-date PDF reader to use our e-books. Our products may include digital rights regarding the management of information and technology. You agree not to tamper with or remove information or technology designed to deter or prevent misuse of our intellectual property.
Products – Replacement
Suppose you ask us to supply a replacement after purchasing or downloading our products. In that case, a replacement will be at our discretion unless you have a statutory right for us to replace the product. For example, our e-books are occasionally updated and replaced, so a replacement may only be available occasionally.
Products – Refunds
If you are unhappy with any digitally downloadable content (e.g., e-books) purchased from our website Store, we will refund you within 30 days of purchase, subject to the provisions below.
By requesting a refund, you certify that:
You have deleted or destroyed all copies of digital content you have in your possession, from which you downloaded, sent to you by other means, or otherwise accessed on our website.
You have not shared copies of the relevant Premium Profile(s) or any premium content with anyone else.
Gift codes and custom orders are non-exchangeable and non-refundable.

Subscriptions – Fee Changes
For subscription services, payments are due (monthly or yearly) on the same or closest date to the day of your first payment. Our fees may change anytime, with a notification being posted on our website. If you object to the fee increase, you can cancel your use of our website and the ongoing provision of products within 30 days of the change by contacting us at jesse@fruitfulkingdom.com. We will refund any advance-paid sums or otherwise related to canceled products. However, you are not entitled to a refund if you have downloaded or accessed products.
Subscriptions – Refunds
For our subscription-based services, we can only refund the final payment linked to your subscription. We do not refund partial months of service or refund for months unused with an open account. Outside of these conditions, and except when required by law, any paid subscription to Fruitful Kingdom is non-refundable.
Your Revocation of Access
You have the right to discontinue using and terminating your access to any of our offering(s). To initiate this process, email jesse@fruitfulkingdom.com.
Our Products & Services
Our Efforts to Sell as Displayed
We make reasonable attempts to accurately display the images and colors of the products in our Store. However, we cannot guarantee the accuracy of the display of our products on your computer’s monitor.
We do not warrant that the quality of our offerings will satisfy your expectations or that any errors in our service will be fixed.
Our Rights to Limit or Stop Sales

Without prejudice to our other rights under these Terms & Conditions, if you breach these Terms in any way, we reserve the right to respond in a way that we determine appropriate, such as suspending, prohibiting, or disabling your access to our website or offering(s), blocking the I.P. associated with your account or requesting that your internet service provider block your access to our website, or bringing court proceedings against you.
Non-Dispargement
If, at our discretion, you are found to be slandering, libeling, or otherwise disparaging Fruitful Kingdom offerings or related materials, you will be immediately removed from the offerings and any associated communications. It is our right to file a civil claim of action against you for any of your damaging actions that materially harm Fruitful Kingdom.
Your Account Disablement - Termination
If you breach any of our Terms & Conditions, we have the right to suspend or disable your access to or use of our services (including blocking your I.P. address) with or without notice to you and in our sole discretion.
If you desire to terminate your account, you may discontinue using our services.
All provisions of our Terms that should survive termination shall survive termination (e.g., ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If, in our sole judgment, you have or we suspect you have failed to comply with our Terms & Conditions, we may terminate this agreement without notice. You are liable for any owed amounts due up to and including the termination date. We may deny you access to our services.
Any remaining amount after 14 days from the termination date will be transferred to a collections agency. You are responsible for any associated additional fees, charges, or costs related to that collection, including reasonable attorney’s fees and court costs.
Our Entire Agreement
Before registering with our website or making any purchases, you must agree to our Privacy Policy. Once consented to, our Privacy Policy, along with these Terms & Conditions and other agreements located on our website, constitute the entire agreement between website users and Fruitful Kingdom relating to the use of this website and the governance of our services.
These Terms & Conditions supersede any prior agreements of Fruitful Kingdom, oral or written communications, between you and us (such as previous versions of the Terms & Conditions). Nothing in our Terms & Conditions can deprive you of your statutory rights.
Any ambiguities in interpreting these Terms & Conditions shall not be construed against the drafting party.
Governing Law
Our Terms & Conditions will be construed and governed according to South Australian law, without regard to its conflict of law provisions. If you live outside of Australia, we agree only to take legal action against each other in Australian courts (except where our Terms are prohibited from overriding any consumer protections applicable to you in your country). However, our intellectual property rights (I.P.R.) may be protected in any country.
Our rights, or those of others, dictated by these Terms are not waived if we fail to enforce them. If a court determines that any portion of our Terms is invalid or unenforceable, the remaining portion will remain in effect.

Dispute Resolution
Suppose you and Fruitful Kingdom cannot resolve a dispute or potential claim through good-faith negotiation. In that case, you explicitly agree to reasonably attempt to resolve your dispute through a Mediation Body or Alternative Dispute Resolution (A.D.R.) before filing a civil cause of action.
A.D.R. is an independent dispute resolution process that seeks to avoid going to court. Suppose you are still unsatisfied with how we have dealt with your complaint, even after we have exhausted our internal complaint handling procedure. In that case, we will communicate our shortcomings in settling your complaint, explain our approach to A.D.R., and recommend an A.D.R. entity for your consideration.
